聘任合同

合同

甲方＿＿＿＿＿＿＿＿愿意聘请乙方＿＿＿＿＿＿＿＿作为外籍教师。双方本着友好合作的原则签署此合同并保证严格履行合同上所规定的条款。乙方的月工资为＿＿＿＿元/月，服务期限从＿＿＿＿年＿＿＿月＿＿＿日至＿＿＿＿年＿＿＿月＿＿＿日。

一、 一、甲方的义务
A：甲方将向乙方介绍中国的法律及有关政策，学校的体制和相关的外教管理规定。
B：甲方将知指导、监督和评估乙方的工作。
C：甲方给乙方提供必要的工作设施和居住条件。
D：甲方将指派一名教师作为乙方的工作联系人，协助其完成工作任务。
E：甲方将按月付给乙方工资。

二、 二、乙方的义务
A：乙方应遵守中国法律、规定和制度，并保证不从事与本人身份不符的活动。
B：乙方应熟悉甲方的工作制度和相关的外教管理规定并接受甲方对工作的指导、安排、监督和评估。未经甲方许可，乙方不得在其它地方兼任工作或担任与甲方工作无关的职位。
C：乙方将按约定的进度完成教学任务并保证教学质量。
D：乙方应尊重中国的宗教政策并且不能够举办一些不适合教师身份的宗教活动。
E：乙方应尊重中国的道德规范和社会习俗。

三、 三、合同的修改、取消和中止
A：双方应遵守合同规定，未经双方许可不得擅自修改、取消和中止合同。
B：经双方许可，可修改、取消和中止合同。在双方未达成新的协议之前，双方要严格遵守合同。
C：甲方有权在以下情况下以书面形式通知乙方中止合同：
1、 1、 乙方不能履行合同，或在甲方提出问题后，乙方仍不能履行条款列明的义务。
2、 2、 乙方在请30天病假之后，经医生诊断不适宜再继续正常工作。
D：乙方有权在以下情况下以书面形式通知甲方中止合同。
1、 1、 甲方未能根据合同给乙方提供必要的工作和居住条件。
2、 2、 甲方未能按规定给乙方报酬。
四、 四、违约处罚
A：如果双方任何一方违反合同规定，应付数额为乙方一个月工资的违约金。
B：如果乙方由于不可预见情况，要求取消合同，需提供有关部门证明并征得甲方同意，但需自付回程费用。
C：如果乙方无正当理由擅自中止合同，需自付回程费用并要向甲方交付罚金。
D：如果甲方由于不可预见情况要中止合同，应得到乙方的许可，但要负担其回程费用。
E：如果甲方无正当理由擅自终止合同，不仅要负担乙方的回程费用而且要向乙方交付罚金。


五、 五、合同附件同正文具有同样效力。
六、 六、此合同自签署之日起生效并且于终止之日自动解除。如果双方中任何一方要求订立新合同。乙方自付在合同终止之后逗留的费用。
七、 七、调解
双方将相互协商解决在合同执行过程中发生的争端。如果努力失败，可以上交外专局外国专家事务组调停。

附件：
一、 一、工资
1、 1、 乙方的报酬根据乙方的工作量和专业技能，及其学历和教学经验所订。甲方将在乙方接受此职位之前告知乙方的报酬标准。
2、 2、 报酬按月付给乙方，自乙方履行职责之日起至合同终止之日止。如果乙方工作不足一个月，则报酬按天数计（每天报酬为月薪的三十分之一）。
3、 3、 甲方将付给乙方人民币＿＿＿＿＿元/月。
4、 4、 乙方如有需要，甲方可协助乙方离境前申请兑换一定数额的外币。

二、 二、交通费用
1、 1、 来程路费由甲方支付。如果乙方遵守合同并完成学年任务，由甲方提供其回国单程经济舱机票。
2、 2、 如果服务期限是一学年或少于半年，甲方将付乙方回国单程机票的半额。

三、 三、证件费用
1、 1、 甲方负责为乙方办理合同期间内居留证和外国专家证，并付办证费用。
2、 2、 甲方负责为乙方办理单次往返签证。甲方可协助乙方伸办多次往返签证，但乙方需付额外费用。

四、 四、享受待遇
1、 1、 甲方为乙方提供一套公寓，配有全套家具及必要的电器或燃器具，包括彩电、空调、冰箱、微波炉、热水器、燃气灶、取暖器、电话等。
2、 2、 甲方为乙方支付每月电话月租费28元及不超过50元的人民币的市内电话费、不超过200元的水电费和不超过100元人民币的煤气开支。超额费用由乙方自付。
3、 3、 乙方享受医疗待遇甲方教职工同等。乙方需付20%的医疗费用。常规治疗在校医院，经校医院医生准许乙方可在外就医，甲方支付在外就医费用但不包括挂号费、出诊、交通费、？牙、洗牙、配眼镜、整容、住院的餐费和非治疗性的补药费用，乙方家属不享受上述待遇。

五、 五、假期
除大学课程安排表上的假期和本地的公众假期之外，乙方可享受两日的特别假期（如圣诞节），聘期为一学年以上者在学校假期时的工资照付

六、 六、病假和事假
1、 1、 当乙方生病，凭医疗证明可请病假。如病情持续半个月，工资可照常发放。如病假超出期限，甲方有权终止合同。
2、 2、 乙方在得到甲方的准许下可请事假，事假期间的报酬将按事假天数从工资中扣除，半年内累计请事假不得超过一周。

七、 七、工作量
乙方的教学工作由＿＿＿＿＿负责人安排，其工作量为每周14课时。

Contract

Party A Foshan University wishes to engage the service of Party B＿＿＿＿as a foreign expert/teacher. The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it. Party B’s monthly salary will be ＿＿＿＿RMB Yuan.
The period of service will be from the ＿＿＿day of ＿＿＿,2000 to the ＿＿＿day of ＿＿＿,2001.

Ⅰ.Party A’s Obligations
1.  Party A shall introduce to Party B the Chinese Laws,decrees and relevant regulations, the Party A’s work system and regulations concerning administration of foreign teachers.
2.  Party A shall conduct direction, supervision and evaluation of Party B’s work.
3.  Party A shall provide Party B necessary working and living conditions.
4.  Party A shall appoint a teacher as Party B’s contact person to assist his/her work.
5.  Party A shall pay Party B’s salary monthly.

Ⅱ:Party B’s Obligations
1. 1. Party B shall observe the Chinese law , decrees and relevant regulations, and shall not paticipate in the activities irrelevant to his/her status.
2.  Party B shall observe Party A’s work system and regulations concerning administration of foreign teachers and shall accept Party A’s arrangement, direction, supervision and evaluation in regard to his/her work. without Party A’s consent , Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agree on with Party A.
3.  Party B shall complete the teaching tasks agreed on schedule and guarantee the quality of work.
4.  Party B shall respect China’s religious policy and shall not conduct religious activities incompatible with the status of a teacher.
5.  Party B shall respect the Chinese people’s moral standards and customs.

Ⅲ. Revision, Cancellation and Termination of the Contract
1. Both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.
2. The contract can be revised, canceled or terminated with mutual consent. Before both parties have reached a new agreement, the contract should be strictly observed.
3. Party A has the right to cancel the contract under the following conditions:
(1) Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out .
(2) According to the doctor’s diagnosis, Party B cannot resume normal work after a continued 30 day sick leave.
4. 4. Party B has the right to cancel the contract with a written notice to Party A under the following conditions.
(1)  Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.
(2)  Party A has not paid Party B as scheduled.

Ⅳ: Breach Penalty
1. When either of the two parties fails to fulfill the contract obligations according to the terms stipulated, that is, breaks the contract, it must pay a breach penalty, which amounts to Party B’s one month salary.
2. If Party B ask to cancel the contract due to events beyond control, it should produce certifications by the department concerned, obtain Party A’s consent, and pay its own return expenses;
3. If Party B cancels the contract without valid reason, it should pay its own return expenses and pay a breach penalty to Party A.
4. If Party A ask to cancel the contract due to events beyond control, with the consent of Party B, it should pay Party B’s return expenses;
5. If party A cancels the contract without valid reason, it should pay Party B’s return expenses and pay a breach penalty to Party B.

Ⅴ:The appendix of this contract is an inseparable part of the contract and has equal effect.

Ⅵ:This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either of the two parties asks for a new contract, it should forward its request to another party 90 days prior to the expiration of the contract, and sign the new contract with mutual consent. Party B shall bear all expenses incurred when staying on after the contract expires.

Ⅶ:Arbitration
The two parties shall consult with each other and meditate any disputes which may arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign experts affairs in the State Bureau of experts and ask for a final arbitration.

Appendix

     Amenities for Foreign Teachers

Ⅰ:Salary
1. 1. The salary of Party B shall be determined in light of the duties undertaken and the professional skill demonstrated, with due reference to academic training, qualifications and teaching experience. Party A shall inform Party B of the amount of salary before he/she consents to accept the position.
2. 2. Salary is paid monthly, commencing on the assumption responsibilities by Party B and ending on the date of the expiration of the contract. If Party B should work less than a month, payment would be made on a daily basis, which amounts to one thirtieth of the month’s salary.
3. 3. Party A shall pay Party monthly salary of＿＿＿＿RMB Yuan (Chinese currency).
4. 4. Party A can assistant Party B to apply for the exchange of certain amount of foreign currency upon departure if necessary.

Ⅱ: Transportation costs
1. 1. The air ticket and other expenses for coming to the place of work in China should be born by Party B .If Party B is under contract for a period of one academic year ,Party A shall provide Party B with one-way economy class air ticket when he/she is returning home at the expiration of the term of service .
2. 2. If the service time is one semester or shorter then six months, Party A will pay to Party B half of a one-way economy class air ticket.

Ⅲ.Certificates Cost
1. 1. Party A shall provide Party B with Foreign Experts Certificate and Permit of Foreigner Residence and bear the cost.
2. 2. Party A shall provide Party B with one entry visa. Party A will help Party B apply for double or multiple entry visa but Party B shall bear the extra cost.

Ⅳ: Benefits
1. 1. Party A will provide Party B with a furnished apartment with necessary electrical or gas appliances (a TV set, a refrigerator, an air conditioner, a microwave oven, a shower water heater, an gas stove, an electric heater, telephone, etc.)
2. 2. Party A will pay for Party B his/her water and electricity bill of less than 200 RMB Yuan , and an gas bill of less than 100 RMB Yuan . The excessive expenditure shall be born by party B.
3. 3. Party B shall enjoy the same Medicare service as faculties of Party A . The university hospital provides ordinary Medicare service . 20% of the fee shall be born by Party B. with the doctor’s advice, Party B may have Medicare treatment outside . Party A will pay the fee but not including the charges for registration, doctor’s home visits, transportation to and from hospital , putting in artificial teeth ,tooth cleaning ,plastic surgery, mounting of spectacles, boarding during hospitalization and non-medical tonics Party B’s non-working family members can not enjoy the above benefits.

Ⅴ: Vacation and Holidays
Besides the vacations in the university timetable and local public holidays, Party B may also enjoy a two-day holiday for Christmas, and the salary is paid as usual during the vacation if the service time exceeds one semester.

Ⅵ: Sick leave and leave for personal matters
1. 1. When Party B is ill and is medically certified, he/her shall ask Party A for sick leave , salary shall be paid as usual even if party B remains sick for half an consecutive month . If sick leave should exceed that limit and Party A refrains from exercising the right stipulated in the contract.
2. 2. Should Party B, with the consent of Party A, ask for leave on account of private business, salary deduction would be made according to the number of days of absence, which are not supposed to be over one week during the period of half an academic year.

Ⅶ:Working Time
The teaching work will be assigned by the chief of ＿＿＿＿.The working time of party B is 14 class hours per week.
