{0>Article 1 This Act is explicitly enacted to encourage the witnesses to testify in the criminal or gangster cases for the purpose of investigation and trial of offense, identifying and trial of gangsters ; and for the benefit of accused or the gangster transferred to court.<}0{>第1條 為保護刑事案件及檢肅流氓案件之證人,使其勇於出面作證,以利犯罪之偵查、審判,或流氓之認定、審理,並維護被告或被移送人之權益,特制定本法。<0}
{0>For matters not provided in this Act, the provisions of other laws shall apply. <}0{>本法未規定者,適用其他法律之規定。<0}
{0>Article 2 The "criminal offenses" referred to in this Act includes the following offenses:<}0{>第2條 本法所稱刑事案件,以下列各款所列之罪為限:<0}
{0>1.The offenses, which are punishable by 3 years or more in prison.<}0{>一最輕本刑為三年以上有期徒刑之罪。<0}

{0>12.The offenses prescribed in Article 50 (1) or Article 50 (2) of the Fishermen Association Act.<}0{>一二漁會法第五十條之一或第五十條之二之罪。<0}

{0>14.The crimes prescribed in Article 9, Paragraphs 1 and 2 of the Money Laundering Act.<}0{>一四洗錢防制法第九條第一項、第二項之罪。<0}
{0>15.The crimes prescribed in Article 3, latter part of Paragraph 1, latter part of Paragraph 2, Article 6 or Article 11, Paragraph 3 of the Statute of Organized Crime Prevention. <}0{>一五組織犯罪防制條例第三條第一項後段、第二項後段、第六條或第十一條第三項之罪。<0}
{0>Article 3 This Act is only applicable to a witness who is willing to testify in front of the prosecutor or in court, state the facts, provide evidences of the criminal offense or gangster activity he or she witnessed; and subject to confrontation and cross-examination according to the law. <}0{>第3條 依本法保護之證人,以願在檢察官偵查中或法院審理中到場作證,陳述自己見聞之犯罪或流氓事證,並依法接受對質及詰問之人為限。<0}
{0>Article 4 If the life, body, freedom or property of a witness or a person who is closely related to such witness is in jeopardy due to his or her testifying in front of the prosecutor or in court, and the protection is necessary, the prosecutor or the judge could issue a protective order by his/her discretion or a petitioned by the witness, the victim or his/her representative, the defendant or his/her defense counsel, the transferred person or his/her retained attorney, the assistant, the judicial police official, the handling agency, or the complainant in private prosecution. <}0{>第4條 證人或與其有密切利害關係之人因證人到場作證,致生命、身體、自由或財產有遭受危害之虞,而有受保護之必要者,法院於審理中或檢察官於偵查中得依職權或依證人、被害人或其代理人、被告或其辯護人、被移送人或其選任律師、輔佐人、司法警察官、案件移送機關、自訴案件之自訴人之聲請,核發證人保護書。<0}
{0>The prosecutor or the judge may take necessary preliminary measures to protect the witness if the protective order is unable to be issued in time in emergency circumstances.<}0{>但時間急迫,不及核發證人保護書者,得先採取必要之保護措施。<0}
{0>During the investigation of criminal or gangster cases, the judicial police agency may take necessary preliminary measures to protect the witness if it is necessary, and should report such measures to the prosecutor or the court within seven days. <}0{>司法警察機關於調查刑事或流氓案件時,如認證人有前項受保護必要之情形者,得先採取必要之保護措施,並於七日內將所採保護措施陳報檢察官或法院。<0}
{0>If such measures are inappropriate, the judge or the prosecutor may modify or terminate it.<}0{>檢察官或法院如認該保護措施不適當者,得命變更或停止之。<0}
{0>The competent court for granting the petition for the protective order should be the court that adjudicates the criminal or gangster case at issue. <}0{>聲請保護之案件,以該管刑事或檢肅流氓案件之法院,為管轄法院。<0}
{0>Article 5 The following items should be specified in the written petition for the protective order:<}0{>第5條 聲請核發證人保護書時,應以書面記載下列事項:<0}
{0>1.the name, gender, date of birth, address of the residence, identification card number or the passport number of the petitioner, and of the protected person;<}0{>一聲請人及受保護人之姓名、性別、出生年月日、住所、身分證統一編號或護照號碼。<0}
{0>2.the case to testify;<}0{>二作證之案件。<0}
{0>3.the facts to testify;<}0{>三作證事項。<0}
{0>4.the reasons the witness is seeking for protection;<}0{>四請求保護之事由。<0}
{0>5.the reasons that the judge or the prosecutor shall provide such protection;<}0{>五有保護必要之理由。<0}
{0>6.the measures of protection. <}0{>六請求保護之方式。<0}
{0>Article 6 In deciding whether to issue the protective order either by its authority or by the petition, the prosecutor or the judge should consider the following factors:<}0{>第6條 檢察官或法院依職權或依聲請核發證人保護書,應參酌下列事項定之:<0}
{0>1.the magnitude and imminence of danger faced by the protected witness and the person who is closely related to such witness;<}0{>一證人或與其有密切利害關係之人受危害之程度及迫切性。<0}
{0>2.the facts of the criminal offender or the gangster conduct;<}0{>二犯罪或流氓行為之情節。<0}
{0>3.the danger of the criminal offense or the gangster;<}0{>三犯罪或流氓行為人之危險性。<0}
{0>4.the importance of the witness´ testimony;<}0{>四證言之重要性。<0}
{0>5.the situation of the witness or of the person who is closely related to such witness;<}0{>五證人或與其有密切利害關係之人之個人狀態。<0}
{0>6.the relationship between the witness and the criminal offense or the gangster activity;<}0{>六證人與犯罪或流氓活動之關連性。<0}
{0>7.the stage of the handling case;<}0{>七案件進行之程度。<0}
{0>8.the restrictions imposed on the rights and interests of the defendant or the transferred person;<}0{>八被告或被移送人權益受限制之程度。<0}
{0>9.the maintenance of the public interest. <}0{>九公共利益之維護。<0}
{0>Article 7 The following items should be specified in the written protective order issued by the prosecutor or the judge:<}0{>第7條 檢察官或法院核發證人保護書,應記載下列事項:<0}
{0>1.the name, gender, date of birth, address of the residence, identification card number or the passport number of the petitioner, and of the protected person;<}0{>一聲請人及受保護人之姓名、性別、出生年月日、住所、身分證統一編號或護照號碼。<0}
{0>2.the case to testify;<}0{>二作證之案件。<0}
{0>3.the reasons for protecting the witness;<}0{>三保護之事由。<0}
{0>4.the reasons the protection is provided;<}0{>四有保護必要之理由。<0}
{0>5.the measures of protection;<}0{>五保護之措施。<0}
{0>6.the period of protection;<}0{>六保護之期間。<0}
{0>7.the executing agency that provides such protection.<}0{>七執行保護之機關。<0}
{0>In deciding what protective measures should be taken, the prosecutor or the judge issuing the protective order should consider the methods stated in Articles 11 to 13 of this Act. <}0{>前項第五款之保護措施,應就第十一條至第十三條所列方式酌定之。<0}
{0>Article 8 The prosecutor or the judge could execute the protective order himself or herself, or could hand over it to the judicial police agency or other executing authority to execute.<}0{>第8條 證人保護書,由檢察官或法院自行或發交司法警察機關或其他執行保護機關執行之。<0}
{0>The prosecutor, judge, judicial police agency, or executing authority prescribed in preceding paragraph could order the protected witness to follow certain rules in compliance with the protective order, and may exercise its authority beyond the scope of its jurisdiction.<}0{>前項執行機關,得依證人保護書之意旨,命受保護人遵守一定之事項,並得於管轄區域外,執行其職務。<0}
{0>Any person involving with the issuance or execution of the protective order must keep all items specified in the protective order confidential. <}0{>所有參與核發及執行第一項保護措施之人,對保護相關事項,均負保密義務。<0}
{0>Article 9 The prosecutor or the judge may terminate or modify the protective order either by its authority or by the petition from the person stated in paragraph 1 of Article 4 or the executing agency if any of the following situations exists:<}0{>第9條 執行證人保護之案件有下列情形之一者,檢察官或法院得依職權或依第四條第一項之人或執行保護機關之聲請,停止或變更保護措施:<0}
{0>1.the protected person agrees to terminate or modify the protective order.<}0{>一經受保護人同意者。<0}
{0>2.the protected witness is convicted for perjury or false accusation.<}0{>二證人就本案有偽證或誣告情事,經有罪判決確定者。<0}
{0>3.the protected person has violated the orders set forth in Paragraph 2 of Article 8.<}0{>三受保護人違反前條第二項應遵守之事項者。<0}
{0>4.the protected person was in custody, detained, sheltered, observed and abstained, compulsorily abstained or was removed to prison or penitentiary.<}0{>四受保護人因案經羈押、鑑定留置、收容、觀察勒戒、強制戒治或移送監獄或保安處分處所執行者。<0}
{0>5.the reasons of protection are disappear or unnecessary more. <}0{>五應受保護之事由已經消滅或已無保護之必要者。<0}
{0>Article 10 The executing authority should frequently review its execution of the protective order. If the reasons that the witness should be protected are disappear or unnecessary more , the executing authority may terminate the protective order by obtaining prior approval from the prosecutor, judge or judicial police agency. <}0{>第10條 保護措施之執行機關,應隨時檢討執行情形,如危害之虞已消失或無繼續保護之必要者,經法院、檢察官或司法警察官同意後,停止執行保護措施。<0}
{0>If the protection is still necessary under some change of circumstances, the executing authority may modify the protective order by obtaining prior approval from the prosecutor, judge or judicial police agency.<}0{>但其因情事變更仍有繼續保護之必要者,得經法院、檢察官或司法警察官同意,變更原有之保護措施。<0}
{0>If it is necessary to reinstate the protective order after the protective order was terminated, the prosecutor or the judge may reissue and execute the protective order either by its authority or by the petition from the person stated in paragraph 1 of Article 4 or the executing agency. <}0{>停止執行保護之案件,有重新保護之必要者,檢察官或法院得依職權或依第四條第一項之人或執行保護機關之聲請,再許可執行保護證人之措施。<0}
{0>Article 11 Except otherwise provided in the law, the true name and identification information of the witness who is necessary to be protected should be used a code name by making a record or document from the public official. <}0{>第11條 有保密身分必要之證人,除法律另有規定者外,其真實姓名及身分資料,公務員於製作筆錄或文書時,應以代號為之,<0}
{0>Any information of the protected witness such as the year of birth, address of the residence, identification number or passport number and other information that is capable of identifying the protected witness should not be recorded on the record or document. <}0{>不得記載證人之年籍、住居所、身分證統一編號或護照號碼及其他足資識別其身分之資料。<0}
{0>The signature of the protected witness should be substituted by the thumbprint of the protected witness.<}0{>該證人之簽名以按指印代之。<0}
{0>The record or the original document that contains the true name or identification information of the protected witness should be stored and sealed in an envelope. <}0{>載有保密證人真實身分資料之筆錄或文書原本,應另行製作卷面封存之。<0}
{0>Other documents that are capable of revealing the identity of the protected witness should also be stored and sealed in an envelope.<}0{>其他文書足以顯示應保密證人之身分者,亦同。<0}
{0>Excepted otherwise provided in the law, any record or document that is stored and sealed in the envelope should not be examined or make available to any agency, group or individual other than the agency in charge of the criminal investigation or trial.<}0{>前項封存之筆錄、文書,除法律另有規定者外,不得供閱覽或提供偵查、審判機關以外之其他機關、團體或個人。<0}
{0>A witness who is protected under this Act may conceal his or her identity by wearing a mask, changing his or her voice, appearance, using video communication or other forms of segregation during the investigation or trial. <}0{>對依本法有保密身分必要之證人,於偵查或審理中為訊問時,應以蒙面、變聲、變像、視訊傳送或其他適當隔離方式為之。<0}
{0>The same methods should be taken to a witness protected under this Act during the confrontation or examination under the law. <}0{>於其依法接受對質或詰問時,亦同。<0}
{0>Article 12 When the life, body, freedom or property of a witness or a person who is closely related to such witness is in imminent danger, the judge or prosecutor may immediately order the judicial police agency to assign a police officer to personally protect the witness or the person who is closely related to such witness within a certain period of time.<}0{>第12條 證人或與其有密切利害關係之人之生命、身體或自由有遭受立即危害之虞時,法院或檢察官得命司法警察機關派員於一定期間內隨身保護證人或與其有密切利害關係之人之人身安全。<0}
{0>The judge or prosecutor may issue an order to prohibit or restrain a specific person to act in a particular way or to prohibit or restrain a specific person to approach the body, residence, work place of the protected witness or the person who is closely related to such witness.<}0{>前項情形於必要時,並得禁止或限制特定之人接近證人或與其有密切利害關係之人之身體、住居所、工作之場所或為一定行為。<0}
{0>To take the measure of prohibition or restraint specified in the preceding paragraph, the judge or prosecutor should issue a protective order with following items:<}0{>法院或檢察官為前項之禁止或限制時,應核發證人保護書行之,並載明下列事項:<0}
{0>1.the protected person and the protected area;<}0{>一受保護之人及保護地點。<0}
{0>2.the prohibited or restrained person;<}0{>二受禁止或限制之特定人。<0}
{0>3.the executing judicial police agency;<}0{>三執行保護之司法警察機關。<0}
{0>4.the prohibited or restrained conduct to the protected person.<}0{>四禁止或限制特定人對受保護人為特定行為之內容。<0}
{0>5.the protective measures of executing judicial police agency.<}0{>五執行保護之司法警察機關應對受保護人為特定行為之內容。<0}
{0>The forgoing protective order should be delivered to the applicant, the prohibited or restrained person, and the executing judicial police agency or relevant authority.<}0{>前項證人保護書,應送達聲請人、應受禁止或限制之人及執行保護措施之司法警察或其他相關機關。<0}
{0>The prohibited or restrained person may object to the protective order issued by the judge or prosecutor .The Criminal Procedure Act shall apply mutatis mutandis to the objection . <}0{>受禁止或限制之人,得對檢察官或法院第二項之命令或裁定聲明不服,其程序準用刑事訴訟法之規定。<0}
{0>Article 13 When the life, body, freedom or property of a witness or a person who is closely related to such witness is in jeopardy, and it is necessary to temporarily alternate life, place or way of work of the witness and the person who is closely related to such witness , the judge or prosecutor may designate an agency to assist him or her in getting a short-term relocation in an appropriate circumstance and changing a new job ,within a certain period of time.<}0{>第13條 證人或與其有密切利害關係之人之生命、身體、自由或財產有遭受危害之虞,且短期內有變更生活、工作地點及方式之確實必要者,法院或檢察官得命付短期生活安置,指定安置機關,在一定期間內將受保護人安置於適當環境或協助轉業,並給予生活照料。<0}
{0>The period mentioned in preceding paragraph should not exceed one year. However, if it is necessary, the prosecutor or judge may agree to extend the protected period to another year. <}0{>前項期間最長不得逾一年。但必要時,經檢察官或法院之同意,得延長一年。<0}
{0>The relocation expenses should be paid from the budget of the Ministry of the Interior.<}0{>所需安置相關經費,由內政部編列預算支應。<0}
{0>To make a decision of relocation mentioned in preceding paragraph, the judge or prosecutor shall issue the protective order. The order should be delivered to the applicant, the designated agency and relevant authority executing the protective measure. <}0{>法院或檢察官為第一項短期生活安置之決定,應核發證人保護書行之,並應送達聲請人、安置機關及執行保護措施之相關機關。<0}
{0>Article 14 Any defendant or suspected who committed or allegedly committed the criminal offenses set forth in Article 2 helps prosecutor to prosecute other accomplices by providing material testimony or evidence, his or her sentence shall be reduced or exempted with prosecutor´s prior approval.<}0{>第14條 第二條所列刑事案件之被告或犯罪嫌疑人,於偵查中供述與該案案情有重要關係之待證事項或其他共犯之犯罪事證,因而使檢察官得以追訴該案之其他共犯者,以經檢察官事先同意者為限,就其因供述所涉之犯罪,減輕或免除其刑。<0}
{0>After considering the seriousness of the criminal offense committed by the defendant or accused, the injuries suffered by the victim, the importance of the serious crime prevention and the significance of the public interests, the prosecutor may assent to drop the charges against a defendant or accused who is not an accomplice in the criminal offenses set forth in Article 2 but helps the prosecutor to prosecute other accomplices committing a more serious offense by providing material testimony or evidence regarding the accessory before the fact, accessory during the fact and accessory after the fact.<}0{>被告或犯罪嫌疑人雖非前項案件之共犯。但於偵查中供述其犯罪之前手、後手或相關犯罪之網絡,因而使檢察官得以追訴與該犯罪相關之第二條所列刑事案件之被告者,參酌其犯罪情節之輕重、被害人所受之損害、防止重大犯罪危害社會治安之重要性及公共利益等事項,以其所供述他人之犯罪情節或法定刑較重於其本身所涉之罪且經檢察官事先同意者為限,就其因供述所涉之犯罪,得為不起訴處分。<0}
{0>The property obtained or used by a defendant from his or her commission of a crime stated in the preceding paragraph shall be confiscated by the prosecutor with the judge´s prior approval.<}0{>前項情形,被告所有因犯罪所得或供犯罪所用之物,檢察官得聲請法院宣告沒收之。<0}
{0>The provisions set forth in Article 253, Paragraphs 2 and 3, and Articles 255 to 260 of the Criminal Procedure Act shall apply mutates mutandis to paragraph 2. <}0{>刑事訴訟法第二百五十三條第二項、第三項、第二百五十五條至第二百六十條之規定,於第二項情形準用之。<0}
{0>Article 15 The provisions set forth in this Act shall apply to the informant, reporter, complainant or victim.<}0{>第15條 檢舉人、告發人、告訴人或被害人有保護必要時,準用保護證人之規定。<0}
{0>While handing over the case to the competent judicial authority or the judicial police agency, the government authority that accepts the complaint from a citizen may request the court, prosecutor or the judicial police agency to take necessary preliminary measures to protect the complainant in accordance with this Act if the government authority considers the true name and the identity of the protected informant should remain confidential. . <}0{>政府機關依法受理人民檢舉案件而認應保密檢舉人之姓名及身分資料者,於案件移送司法機關或司法警察機關時,得請求法院、檢察官或司法警察官依本法身分保密之規定施以保護措施。<0}
{0>Article 16 Any government official who reveals, discloses or hands over papers, documents, pictures, information or things capable of identifying the witness protected under this Act to others, shall be sentenced to imprisonment between one year and seven years.<}0{>第16條 公務員洩漏或交付關於依本法應受身分保密證人之文書、圖畫、消息、相貌、身分資料或其他足資辨別證人之物品者,處一年以上七年以下有期徒刑。<0}
{0>An attempt offense of the crime set forth in the preceding paragraph shall be punishable.<}0{>前項之未遂犯,罰之。<0}
{0>A negligent crime of preceding paragraph 1-2 shall be sentenced to imprisonment of not more than two years, detention, or be imposed a fine of not more than NT $ 300,000 dollars.<}0{>因過失犯前兩項之罪者,處二年以下有期徒刑、拘役或科新台幣三十萬元以下罰金。<0}
{0>Any person who is not a government official obtains papers, documents, pictures, information or things capable of identifying the witness protected under this Act within the scope of his authority or employment, reveals, discloses or hands over these to others, shall be sentenced to imprisonment of not more than three years, detention, or be imposed a fine of not more than NT $ 500,000 dollars. <}0{>非公務員因職務或業務知悉或持有第一項之文書、圖畫、消息、相貌、身分資料或其他足資辨別證人之物品,而洩漏或交付之者,處三年以下有期徒刑、拘役或科新台幣五十萬元以下罰金。<0}
{0>Article 17 The restraining person who intentionally violates the provisions set forth in the Article 12, Paragraph 2 and was acting against the executing authority´s demand to comply with the restraining order, shall be sentenced to imprisonment of not more than three years, detention, or be imposed a fine of not more than NT $ 500,000 dollars. <}0{>第17條 受禁止或限制之人故意違反第十二條第二項之規定,經執行機關制止不聽者,處三年以下有期徒刑、拘役或科新台幣五十萬元以下罰金。<0}
{0>Article 18 Any person who attempts to prevent or retaliate the protected witness to testify in front of the prosecutor or in court and commits a crime against the protected witness, shall be subject to the punishment prescribed for such offense increased up to one half. <}0{>第18條 意圖妨害或報復依本法保護之證人到場作證,而對受保護人實施犯罪行為者,依其所犯之罪,加重其刑至二分之一。<0}
{0>Article 19 Any protected witness will be considered to have committed the perjury by making a false statement on the material facts of the criminal case or gangster case at issue, and shall be sentenced to imprisonment between one year and seven years. <}0{>第19條 依本法保護之證人,於案情有重要關係之事項,向該管公務員為虛偽陳述者,以偽證論,處一年以上七年以下有期徒刑。<0}
{0>Article 20 The judge has discretion not to hold a public trial if the judge consider the public trial would put the life, body or freedom of the protected witness in jeopardy. <}0{>第20條 訴訟之辯論,有危害證人生命、身體或自由之虞者,法院得決定不公開。<0}
{0>Article 21 The provisions set forth in this Act shall apply mutates mutandis to the case handled by military courts, prosecutors . <}0{>第21條 本法之規定,於軍事法院及軍事法院檢察署檢察官受理之案件,準用之。<0}
{0>Article 22 The Enforcement Rules of this Act shall be enacted by the Executive Yuan after consulting with the Judicial Yuan. <}0{>第22條 本法之施行細則,由行政院會同司法院定之。<0}
{0>Article 23 This Act shall go into effect on the day of promulgation.<}0{>第23條 本法自公布日施行。<0}
