{0>Article 1 Protection for Workers Incurring Occupational Accidents Act (hereinafter referred to as the Act) is drawn upon for protecting the rights of workers incurring occupational accidents, strengthening the prevention of occupational accidents, and promoting employment security and economic development; matters not herein stipulated shall be governed by other applicable acts. <}0{>第1條 為保障職業災害勞工之權益,加強職業災害之預防,促進就業安全及經濟發展,爰制定本法;本法未規定者,適用其他法律之規定。<0}
{0>Article 2 The competent authorities denoted in the Act are the Council of Labor Affairs of the Executive Yuan at the central level, the municipal government at the municipal level, and the county/city government at the county/city level. <}0{>第2條 本法所稱主管機關:在中央為行政院勞工委員會;在直轄市為直轄市政府;在縣(市)為縣(市)政府。<0}
{0> Chapter II Sources of Fund, Uses, Management and Supervision<}0{>第二章經費來源、用途、管理及監督<0}
{0>Article 3 The central competent authority shall appropriate use-designated fund from the surplus of occupational accident insurance balance of the Labor Insurance Fund for strengthening the prevention of occupational accidents, and subsidizing workers participating in the labor insurance scheme and incurring occupational accidents. The fund shall be exempt from Paragraph 2 of Article 67 of the Labor Insurance Act, and its accounting shall be dealt with separately.<}0{>第3條 中央主管機關應自勞工保險基金職業災害保險收支結餘提撥專款,作為加強辦理職業災害預防及補助參加勞工保險而遭遇職業災害勞工之用,不受勞工保險條例第六十七條第二項規定之限制,其會計業務應單獨辦理。<0}
{0>The fund denoted in the previous paragraph, apart from the amount appropriated in a lump sum according to budget procedures from the surplus of occupational accident insurance balance of the Labor Insurance Fund, includes also the amount appropriated from forty percent to sixty percent of the surplus of occupational accident insurance balance of the Labor Insurance Fund in the previous financial year. <}0{>前項專款,除循預算程序由勞工保險基金職業災害保險收支結餘一次提撥之金額外,並按年由上年度收支結餘提撥百分之四十以上,百分之六十以下之金額。<0}
{0>Article 4 The central competent authority shall draft a budget of use-designated fund for subsidizing workers not participating in the labor insurance scheme, but incurring occupational accidents; and its accounting shall be dealt with separately.<}0{>第4條 中央主管機關應編列專款預算,作為補助未加入勞工保險而遭遇職業災害勞工之用,其會計業務應單獨辦理。<0}
{0>Administrative fine imposed according to Article 33 and Article 34 herein shall be appropriated into the fund denoted in the previous paragraph. <}0{>依第三十三條及第三十四條所處之罰鍰,應撥入前項專款。<0}
{0>Article 5 Matters concerning the receipts and payments, management and examination of use-designated funds denoted in the previous articles shall be administered by the Bureau of Labor Insurance, Council of Labor Affairs, Executive Yuan; and the Labor Insurance Supervisory Committee, Council of Labor Affairs, Executive Yuan is responsible for supervision and review.<}0{>第5條 前二條專款之收支、管理及審核事項,由行政院勞工委員會勞工保險局辦理,並由行政院勞工委員會勞工保險監理委員會負責監督及審議。<0}
{0>Expenses required by the labor insurance institutions for handling businesses stipulated in the Act shall be defrayed by the budget drafted in accordance with Article 68 of the Labor Insurance Act. <}0{>勞工保險機構辦理本法規定各項業務所需費用,由依勞工保險條例第六十八條規定編列之預算支應。<0}
{0>Article 6 When a worker not participating in the labor insurance scheme, but incurring an occupational accident is not compensated according to the provisions of Labor Standards Act by the employer concerned, the worker may in the light of the standards of Labor Insurance Act apply for disability or death subsidies of occupational accident in accordance with the minimum grade of insurance salary.<}0{>第6條 未加入勞工保險而遭遇職業災害之勞工,雇主未依勞動基準法規定予以補償時,得比照勞工保險條例之標準,按最低投保薪資申請職業災害殘廢、死亡補助。<0}
{0>The subsidy denoted in the previous paragraph shall be deducted the amount of compensation already paid by the employer concerned.<}0{>前項補助,應扣除雇主已支付之補償金額。<0}
{0>Residual physical handicap of an applicant for disability subsidy in accordance with Paragraph 1 shall conform to the items and benefit standards of category 1 to category 10 as set forth in the Disability Benefits Payment Schedule of labor insurance scheme.<}0{>依第一項申請殘廢補助者,其身體遺存障害須適合勞工保險殘廢給付標準表第一等級至第十等級規定之項目及給付標準。<0}
{0>When the employer concerned compensates an occupational accident in accordance with the provisions of Labor Standards Act, subsidy in Paragraph 1 may offset. <}0{>雇主依勞動基準法規定給予職業災害補償時,第一項之補助得予抵充。<0}
{0>Article 7 An employer shall be liable for damage or loss compensation of a worker incurring occupational accident, unless the employer concerned can prove to be flawless. <}0{>第7條 勞工因職業災害所致之損害,雇主應負賠償責任,但雇主能證明無過失者,不在此限。<0}
{0>Article 8 If an insured person of labor insurance scheme incurs after enforcement of the Act an occupational accident during the effective period of insurance coverage, the person concerned may apply for the following subsidies:<}0{>第8條 勞工保險之被保險人,在保險有效期間,於本法施行後遭遇職業災害,得向勞工保險局申請下列補助:<0}
{0>1. When suffering an occupational disease and being deprived of partial or full capability to work, the person concerned may apply for living allowance after receiving each occupational accident benefit of labor insurance scheme.<}0{>一罹患職業疾病,喪失部分或全部工作能力,經請領勞工保險各項職業災害給付後,得請領生活津貼。<0}
{0>2. Owing to residual physical handicap caused by an occupational accident and being deprived of partial or full capability to work, the person concerned may apply for disability living allowance when residual physical handicap conforms to the items of category 1 to category 7 as set forth in the Disability Benefits Payment Schedule of labor insurance scheme.<}0{>二因職業災害致身體存障害,喪失部分或全部工作能力,適合勞工保險殘廢給付標準表第一等級至第七等級規定之項目,得請領殘廢生活津貼。<0}
{0>3. After incurring an occupational accident, the person concerned may apply for living allowance if receiving no training subsidy or living allowances denoted in the previous subparagraphs during the period of participating in vocational training.<}0{>三發生職業災害後,參加職業訓練期間,未請領訓練補助津貼或前二款之生活津貼,得請領生活津貼。<0}
{0>4. Owing to residual physical handicap caused by an occupational accident and requiring assistant device, the person concerned may apply for device subsidy only when receiving no device subsidy stipulated in other acts.<}0{>四因職業災害致身體遺存障害,必需使用輔助器具,且未依其他法令規定領取器具補助,得請領器具補助。<0}
{0>5. Owing to the loss of partial or full capability to live independently caused by an occupational accident and requiring care-taker, the person concerned may apply for care-taking subsidy only when receiving no relevant subsidy stipulated in other acts.<}0{>五因職業災害致喪失全部或部分生活自理能力,確需他人照顧,且未依其他法令規定領取有關補助,得請領看護補助。<0}
{0>6. In the case of death caused by an occupational accident, family of the person concerned may be given necessary subsidies.<}0{>六因職業災害死亡,得給予其家屬必要之補助。<0}
{0>7. Other subsidies for workers incurring occupational accidents approved by the central competent authority.<}0{>七其他經中央主管機關核定有關職業災害勞工之補助。<0}
{0>After the termination of labor insurance coverage, the insured person of labor insurance scheme may apply for living allowance only when the person concerned being diagnosed by a physician of contracting occupational disease, of which had been contracted during the effective period of insurance coverage, and receiving no labor insurance benefits and incapable of working.<}0{>勞工保險效力終止後,勞工保險被保險人,挳醫師診斷罹患職業疾病,且該職業疾病係於保險有效期間所致,且未請領勞工保險給付及不能繼續從事工作者,得請領生活津貼。<0}
{0>The maximal period of receiving subsidies stipulated in Subparagraph 1, Subparagraph 2, Subparagraph 5 of Paragraph 1 and the previous paragraph is no more than five years.<}0{>請領第一項第一款、第二款、第五款及前項之補助,合計以五年為限。<0}
{0>Regulations concerning conditions, standards, application procedures, and examination and issuance of subsidies stipulated in Paragraph 1 and Paragraph 2 shall be determined by the central competent authority. <}0{>第一項及第二項補助之條件、標準、申請程序及核發辦法,由中央主管機關定之。<0}
{0>Article 9 A worker not participating in the labor insurance scheme incurs an occupational accident after enforcement of the Act may apply for subsidy if matching provisions of subparagraphs of Paragraph 1 of the previous article.<}0{>第9條 未加入勞工保險之勞工,於本法施行後遭遇職業災害,符合前條第一項各款情形之一者,得申請補助。<0}
{0>The maximal period of receiving subsidies stipulated in Subparagraph 1, Subparagraph 2, and Subparagraph 5 of Paragraph 1 of the previous article is no more than five years.<}0{>請領前條第一項第一款、第二款及第五款之補助,合計以三年為限。<0}
{0>Regulations concerning conditions, standards, application procedures, and examination and issuance of subsidies stipulated in Paragraph 1 shall be determined by the central competent authority. <}0{>第一項補助之條件、標準、申請程序及核發辦法,由中央主管機關定之。<0}
{0>Article 10 For strengthening the prevention of occupational accidents and rehabilitation of workers incurring occupational accidents, business establishments, vocational training institutions and relevant groups in handling the following matters may apply for subsidies from the Bureau of Labor Insurance:<}0{>第10條 為加強職業災害預防及職業災害勞工之重建,事業單位、職業訓練機構及相關團體辦理下列事項,得向勞工保險局申請補助:<0}
{0>1. Research in relation to occupational accidents.<}0{>一職業災害之研究。<0}
{0>2. Occupational disease prevention.<}0{>二職業疾病之防治。<0}
{0>3. Training of occupational disease physicians and nursing persons of occupational health.<}0{>三職業疾病醫師及職業衛生護理人員之培訓。<0}
{0>4. Improvement of safety and health facilities, establishment of management institution, and promotion of safety institution of mechanical essence.<}0{>四安全衛生設施之改善與管理制度之建立及機械本質安全化制度之推動。<0}
{0>5. Education and training and publicity of occupational safety and health.<}0{>五勞工安全衛生之教育訓練及宣導。<0}
{0>6. Occupational rehabilitation of workers incurring occupational accidents.<}0{>六職業災害勞工之職業重建。<0}
{0>7. Occupational consultation evaluation of workers incurring occupational accidents.<}0{>七職業災害勞工之職業輔導評量。<0}
{0>8. Other matters concerning the prevention of occupational accident and occupational rehabilitation.<}0{>八其他與職業災害預防及職業重建有關之事項。<0}
{0>Regulations concerning conditions, standards, application procedures, and examination and issuance of subsidies stipulated in the previous paragraph shall be determined by the central competent authority. <}0{>前項補助之條件、標準與申請程序及核發辦法,由中央主管機關定之。<0}
{0> Chapter III Decision and Examination on Occupational Diseases<}0{>第三章職業疾病認定及鑑定<0}
{0>Article 11 A worker who is suspected of contracting an occupational disease shall be diagnosed by a physician. When disagreeing with the diagnostic result concerning the occupational disease, the worker concerned or the employer concerned may prepare relevant documents and data and submit application to the competent authorities of municipal or county/city government for decision. <}0{>第11條 勞工疑有職業疾病,應經醫師診斷。勞工或雇主對於職業疾病診斷有異議時,得檢附有關資料,向直轄市、縣(市)主管機關申請認定。<0}
{0>Article 12 For protecting the rights of worker contracting occupation disease, the competent authorities of municipal or county/city government may establish Decision on Occupational Disease Committee for making decision on occupational diseases.<}0{>第12條 直轄市、縣(市)主管機關為認定職業疾病,確保罹患職業疾病勞工之權益,得設置職業疾病認定委員會。<0}
{0>The provisions of Article 14 to Article 16 shall apply mutatis to the organization, decision procedures, and meeting of Decision on Occupational Disease Committee stipulated in the previous paragraph. <}0{>前項職業疾病認定委員會之組織、認定程序及會議,準用第十四條至第十六條之規定。<0}
{0>Article 13 When the competent authorities of municipal or county/city government have difficulty in making decision on an occupational disease, workers or employers disagree with the decision on an occupational disease by the competent authorities of municipal or county/city government, or labor insurance institutions deems it necessary in the case of examining and approving an occupational disease, relevant documents and data may be prepared and submitted to the competent authorities of municipal or county/city government for decision. <}0{>第13條 直轄市、縣(市)主管機關對於職業疾病認定有困難及勞工或雇主對於直轄市、縣(市)主管機關認定職業疾病之結果有異議,或勞工保險機構於審定職業疾病認有必要時,得檢附有關資料,向中央主管機關申請鑑定。<0}
{0>Article 14 For examining occupational diseases and protecting the rights of workers incurring occupational diseases, the central competent authority shall establish the Examination on Occupational Disease Committee (hereinafter referred to as the Examination Committee).<}0{>第14條 中央主管機關為鑑定職業疾病,確保罹患職業疾病勞工之權益,應設職業疾病鑑定委員會(以下簡稱鑑定委員會)。<0}
{0>The Examination Committee shall consist of thirteen to seventeen committee members, and the central competent authority shall select and invite committee members form the following persons, and appoint one of the committee members as the chairperson:<}0{>鑑定委員會置委員十三人至十七人,由中央主管機關遴聘下列人員組成之,並指定委員一人為主任委員:<0}
{0>1. Two delegates from the central competent authority.<}0{>一中央主管機關代表二人。<0}
{0>2. One delegate from the Department of Health of the Executive Yuan.<}0{>二行政院衛生署代表一人。<0}
{0>3. Eight to twelve physicians with specialty in occupational diseases.<}0{>三職業疾病專門醫師八人至十二人。<0}
{0>4. One expert in occupational safety and health.<}0{>四職業安全衛生專家一人。<0}
{0>5. One expert in laws <}0{>五法律專家一人。<0}
{0>The term of office for committee members is two years, and may be extended by the expiration date of term of office; the committee members who delegate government agencies shall stay and quit with their main jobs. <}0{>委員任期二年,期滿得續聘之,代表機關出任者,應隨其本職進退。<0}
{0>Article 15 The Examination Committee may hold a meeting only when more than one half of committee member attend and physicians with specialty in occupational diseases shall be no less than one half of the attending committee members; when meeting, committee members shall attend in person. <}0{>第15條 鑑定委員會應有委員超過二分之一出席,且出席委員中職業疾病專門醫師應超過二分之一,始得開會;開會時,委員應親自出席。<0}
{0>For providing occupation disease-related data, the Examination Committee if necessary may ask relevant medical associations to provide data or send delegate(s) for attendance with on voting right.<}0{>為提供職業疾病相關資料,鑑定委員會於必要時,得委請有關醫學會提供資料或於開會時派員列席。<0}
{0>In consideration of the condition or requirement of each case, the Examination Committee when meeting may invite other experts, relevant persons or delegates of government agencies to attend. <}0{>鑑定委員會開會時,得視案情需要,另邀請專家、有關人員或機關代表一併列席。<0}
{0>Article 16 When accepting the application for occupation disease examination, the central competent authority shall immediately send the relevant data to committee members of the Examination Committee for review in writing, and make decision only in the case that more than three-quarters of the committee members are common in their opinions.<}0{>第16條 中央主管機關受理職業疾病鑑定之申請案件時,應即將有關資料送請鑑定委員會委員作書面審查,並以各委員意見相同者四分之三以上,決定之。<0}
{0>When in accordance with the previous paragraph no decision can be made, the central competent authority shall ask committee members of the Examination Committee for the second review in writing, and make decision only in the case that more than two-thirds of the committee members are common in their opinions.<}0{>未能依前項做成鑑定決定時,由中央主管機關送請鑑定委員會委員作第二次書面審查,並以各委員意見相同者三分之二以上,決定之。<0}
{0>When no decision can be made after the second review, the chairperson of the Examination Committee shall call an all-member meeting for review, and make decision in the case that more than one half of the committee members are common in their opinions. <}0{>第二次書面審查未能做成鑑定決定時,由鑑定委員會主任委員召集全體委員開會審查,經出席委員投票,以委員意見相同者超過二分之一,決定之。<0}
{0>Article 17 When the Examination Committee deems it necessary, the central competent authority shall arrange committee members in cooperation with labor inspectors based upon the Labor Inspection Act to inspect the workplace of the worker concerned. <}0{>第17條 職業疾病鑑定委員會認有必要時,得由中央主管機關安排職業疾病鑑定委員,依勞動檢查法會同勞動檢查員至勞工工作場所檢查。<0}
{0> Chapter IV Promoting Employment<}0{>第四章促進就業<0}
{0>Article 18 After the termination of medical care for a worker incurring an occupational accident, the competent authorities may provide employment assistance to the worker concerned on the basis of the worker´s willingness and capability to work; <}0{>第18條 職業災害勞工經醫療終止後,主管機關得依其意願及工作能力,協助其就業;<0}
{0>in the case of deficiency in skill and competency, the competent authorities may consult the worker concerned to participate in vocational training and assist in returning promptly to employment place. <}0{>對於缺乏技能者,得輔導其參加職業訓練,協助其迅速重返就業場所。<0}
{0>Article 19 When handling the training stipulated in the previous paragraph, vocational training institutions shall arrange educational and training courses of proper hours in occupational safety and health. <}0{>第19條 職業訓練機構辦理前條訓練時,應安排適當時數之勞工安全衛生教育訓練課程。<0}
{0>Article 20 When hiring workers incurring occupational accidents and providing them with necessary auxiliary facilities to work, business establishments may apply for subsidy form the Bureau of Labor Insurance, unless business establishments have received subsidies in accordance with relevant provisions of the Protection for the Physically and Mentally Disabled Act. <}0{>第20條 事業單位僱用職業災害勞工,而提供其從事工作必要之輔助設施者,得向勞工保險局申請補助。但已依身心障礙者保護法有關規定領取補助者,不在此限。<0}
{0>Article 21 The competent authorities may reward business establishments for their outstanding performance in hiring workers incurring occupational accidents. <}0{>第21條 主管機關對於事業單位僱用職業災害勞工績優者,得予以獎勵。<0}
{0> Chapter V Other Protections<}0{>第五章其他保障<0}
{0>Article 22 After the termination of medical care for a worker incurring an occupational accident, the competent authorities of municipal and county/city governments when discovering the worker suspected to be physically or mentally disabled shall inform local competent authorities of social administration to actively provide assistance. <}0{>第22條 職業災害勞工經醫療終止後,直轄市、縣(市)主管機關發現其疑似有身心障礙者,應通知當地社會行政主管機關主動協助。<0}
{0>Article 23 An employer may terminate the labor contract of a worker incurring an occupational accident with advance notice if one of the following conditions occurs:<}0{>第23條 非有下列情形之一者,雇主不得預告終止與職業災害勞工之勞動契約:<0}
{0>1. The employer´s business is suspended or confronted with serious loss, and prior approval has been obtained form the competent authority.<}0{>一歇業或重大虧損,報經主管機關核定者。<0}
{0>2. After the termination of medical care for a worker incurring an occupational accident, a public medical institution decides that the worker concerned is mentally deranged or physically disabled and incapable of working.<}0{>二職業災害勞工經醫療終止後,經公立醫療機構認定心神喪失或身體殘廢不堪勝任工作者。<0}
{0>3. The employer´s business cannot continue because if natural disaster, incident or other acts of God, and prior approval has been obtained form the competent authority. <}0{>三因天災、事變或其他不可抗力因素,致事業不能繼續經營,報經主管機關核定者。<0}
{0>Article 24 A worker incurring an occupational accident may terminate the labor contract if one of the following conditions occurs:<}0{>第24條 有下列情形之一者,職業災害勞工得終止勞動契約:<0}
{0>1. A public medical institution decides that the worker concerned is mentally deranged or physically disabled and incapable of working.<}0{>一經公立醫療機構認定心神喪失或身體殘廢不堪勝任工作者。<0}
{0>2. The business establishment is terminated due to the restructure or ownership transfer.<}0{>二事業單位改組或轉讓,致事業單位消滅者。<0}
{0>3. The employer does not abide by the stipulation of Article 27.<}0{>三雇主未依第二十七條規定辦理者。<0}
{0>4. The worker concerned cannot reach an agreement on job placement with the employer who is intended to follow the stipulation of Article 27. <}0{>四對雇主依第二十七條規定安置之工作未能達成協議者。<0}
{0>Article 25 When an employer according to the stipulation of Subparagraph 1, Subparagraph 3 of Article 23 or a worker according to the stipulation of Subparagraph 2 to Subparagraph 4 of Article 23 terminates the labor contract, the employer concerned shall in accordance with the provisions of Labor Standards Act pay the worker severance.<}0{>第25條 雇主依第二十三條第一項第一款、第三款,或勞工依第二十四條第二款至第四款規定終止勞動契約者,雇主應依勞動基準法之規定,發給勞工資遣費。<0}
{0>When an employer according to the stipulation of Subparagraph 2 of Article 23 or a worker according to the stipulation of Subparagraph 1 of Article 23 terminates the labor contract, the employer concerned shall in accordance with the provisions of Labor Standards Act pay the worker retirement payments.<}0{>雇主依第二十三條第一項第二款,或勞工依第二十四條第一款規定終止勞動契約者,雇主應依勞動基準法之規定,發給勞工退休金。<0}
{0>A worker incurring an occupational accident can only claim one of the rights prescribed in the previous paragraphs and the right of either severance or retirement payments in accordance with the provisions of Labor Standards Act. <}0{>前二項請求權與勞動基準法規定之資遣費,退休金請求權,職業災害勞工應擇一行使。<0}
{0>Article 26 When an employer terminates in accordance with the stipulation of Article 23 the labor contract of a worker incurring an occupational accident with advance notice, the provisions in relation to notify worker in advance of Labor Standards Act shall apply mutatis.<}0{>第26條 雇主依第二十三條第一項規定預告終止與職業災害勞工之勞動契約時,準用勞動基準法規定預告勞工。<0}
{0>When a worker incurring an occupational accident terminates in accordance with the stipulation of Subparagraph 1 of Article 24 the labor contract, the provisions in relation to notify employer in advance of Labor Standards Act shall apply mutatis. <}0{>職業災害勞工依第二十四條第一款規定終止勞動契約時,準用勞動基準法規定預告雇主。<0}
{0>Article 27 After the termination of medical care for a worker incurring an occupational accident, the employer shall place the worker concerned with a suitable job in accordance with the worker´s physical conditions and capability and provide the worker with auxiliary facilities necessary for engaging in work. <}0{>第27條 職業災害勞工經醫療終止後,雇主應按其健康狀況及能力,安置適當之工作,並提供其從事工作必要之輔助設施。<0}
{0>Article 28 A worker retained after restructure or ownership transfer of business establishment is physically or mentally disabled and loses partial or full capability to work because of an occupational accident, the original rights of the retained worker in accordance with law and labor contract shall be recognized by the new employer. <}0{>第28條 事業單位改組或轉讓後所留用之勞工,因職業災害致身心障礙、喪失部分或全部工作能力者,其依法令或勞動契約原有之權益,對新雇主繼續存在。<0}
{0>Article 29 A worker prior to the decision on occupational accident may in accordance with Article 4 of the Regulations on Leave-taking by Workers take ordinary sickness leave first, and the employer concerned shall retain the worker´s job without salary after the expiration of ordinary sickness leave; if the result of decision on occupational accident is affirmative, the worker´s leave shall be dealt with by occupational sickness leave. <}0{>第29條 職業災害未認定前,勞工得依勞工請假規則第四條規定,先請普通傷病假,普通傷病假期滿,雇主應予留職停薪,如認定結果為職業災害,再以公傷病假處理。<0}
{0>Article 30 When a worker participating in labor insurance scheme incurs an occupational accident, and terminates the labor contract and withdraws form the insurance during the period of medical care for occupational accident, the worker concerned may be insured under a labor organization or a relevant organization entrusted by the Bureau of Labor Insurance as the insured unit and continue to participate in the ordinary incident insurance of labor insurance scheme until the date of being entitled to receiving old-age benefit, and being exempt from Article 6 of the Labor Insurance Act.<}0{>第30條 參加勞工保險之職業災害勞工,於職業災害醫療期間終止勞動契約並退保者,得以勞工團體或勞工保險局委託之有關團體為投保責任,繼續參加勞工保險普通事故保險,至符合請領老年給付之日止,不受勞工保險條例第六條之限制。<0}

{0>The business establishment or the contractor in the previous paragraph may claim for reimbursement for the portion borne from the employer of worker incurring an occupational accident.<}0{>前項事業單位或承攬人,就其所補償之部分,對於職業災害勞工之雇主,有求償權。<0}
{0>Standards for compensating the occupational accident stipulated in the previous two paragraphs shall follow the provisions of Labor Standards Act. The expense that an employer of worker has already paid for the same incident in accordance with the Labor Insurance Act or other acts may offset the compensation. <}0{>前二項職業災害補償之標準,依勞動基準法之規定。同一事故,依勞工保險條例或其他法令規定,已由僱用勞工之雇主支付費用者,得予抵充。<0}
{0>Article 32 When a civil lawsuit is brought forward due to an occupational accident, the court shall in terms of the application of worker incurring an occupational accident decide to provide the worker with lawsuit assistance, unless it is pessimistic to win the lawsuit.<}0{>第32條 因職業災害所提民事訴訟,法院應依職業災害勞工聲請,以裁定准予訴訟救助。但顯無勝訴之望者,不在此限。<0}
{0>When a worker incurring an occupational accident applies for safety assurance or false execution, the court may waive the amount of guarantee for the worker. <}0{>職業災害勞工聲請保全或假執行時,法院得減免其供擔保之金額。<0}
{0> Chapter VI Penal Provisions<}0{>第六章罰則<0}
{0>Article 33 When an employer violates the stipulation of Article 17, Paragraph 1 and Paragraph 2 of Article 25, or Article 27 to Article 29, the competent authorities shall notify the employer concerned to improve in a definite time and impose administrative fine of not less than fifty thousand New Taiwan dollars but not exceeding three hundred thousand New Taiwan dollars. <}0{>第33條 雇主違反第十七條、第二十五條第一項、第二項、第二十七條至第二十九條規定者,主管機關應通知限期改善,並處新台幣五萬元以上三十萬元以下罰鍰。<0}
{0>If improvement is not completed within the definite time or within an extended time, an administrative fine can be imposed for each offence until the improvement is completed. <}0{>經限期改善或繼續限期改善,而未如期改善者,得按次分別處罰,至改善為止。<0}
{0>Article 34 When an employer fails to arrange a worker to participate in the labor insurance scheme as required by law, and the worker concerned incurs an occupational accident, the employer shall be imposed an administrative fine equivalent to four to ten times the total amount of insurance premiums required to pay since the date of hiring till the date of accident occurrence, and the stipulation concerning administrative fine prescribed in Paragraph 1 of Article 72 of the Labor Insurance Act shall not apply herein. <}0{>第34條 依法應為所屬勞工辦理加入勞工保險而未辦理之雇主,其勞工發生職業災害事故者,按僱用之日至事故發生之日應負擔之保險費金額,處以四倍至十倍罰鍰,不適用勞工保險條例第七十二條第一項有關罰鍰之規定。<0}
{0>If a worker incurring an occupational accident is dead or has residual physical handicap in conformity with the items of category 1 to category 10 as set forth in the Disability Benefits Payment Schedule of labor insurance scheme, the employer shall be imposed an administrative fine equivalent to the amount of subsidy prescribed in Article 6. <}0{>但勞工因職業災害致死亡或身體遺存障害適合勞工保險給付標準表第一等級至第十等級規定之項目者,處以第六條補助金額之相同額度之罰鍰。<0}
{0>Article 35 An administrative fine prescribed in the Act remains unpaid within a definite time; the case may be referred to the court for compulsory execution. <}0{>第35條 依本法所處之罰鍰,經限期繳納,屆期仍不繳納者,依法強制執行。<0}
{0> Chapter VII Supplementary Provisions<}0{>第七章附則<0}
{0>Article 36 When the Bureau of Labor Insurance handles the matters prescribed in the Act, all relevant documents and operational receipts and payments shall be exempt from taxation. <}0{>第36條 勞工保險局辦理本法規定事項有關單據及業務收支,均免課稅捐。<0}
{0>Article 37 The Bureau of Labor Insurance in handling the matters prescribed in the Act shall establish a review committee.<}0{>第37條 勞工保險局辦理本法有關事項,得設審查委員會。<0}
{0>The organization and duties of the committee prescribed in the previous paragraph shall be determined by the central competent authority. <}0{>前項委員會組織、職掌等,由中央主管機關定之。<0}
{0>Article 38 Subsidies prescribed in Article 10 and Article 20 of the Act, after being examined by the Bureau of Labor Insurance, shall be referred to the Labor Insurance Supervisory Committee for review.<}0{>第38條 本法第十條及第二十條所定補助,經勞工保險局審核後,應提請勞工保險監理委員會審議。<0}
{0>When the Labor Insurance Supervisory Committee reviews the subsidies prescribed in the previous paragraph, delegates of competent authorities in health and vocational training, physician(s) with specialty in occupational diseases, delegate(s) of labor organization of occupational accident, and expert(s) in occupational safety and health shall be invited for attendance with no voting right. <}0{>勞工保險監理委員會審議前項補助時,應邀請衛生及職業訓練主管機關代表、職業疾病專門醫師、職業災害勞工團體代表及職業安全衛生專家等列席。<0}
{0>Article 39 The government shall erect a Monument for the death of workers, fix the twenty-eighth of April every year as Memorial Day for the death of workers, and promotes the safety and health education for workers. <}0{>第39條 政府應建立工殤紀念碑,定每年四月二十八日為工殤日,推動勞工安全衛生教育。<0}
{0>Article 40 The enforcement rules of the Act shall be determined by the central competent authority. <}0{>第40條 本法施行細則,由中央主管機關定之。<0}
{0>Article 41 The Act shall be put into effect on the twenty-eighth of April, 2002.<}0{>第41條 本法自民國九十一年四月二十八日起施行。<0}
