{0>Article 1 These Rules are adopted pursuant to the provisions of Article 16 of the Vocational School Law ("the Law").<}0{>第1條 本規程依職業學校法 (以下簡稱本法) 第十六條規定訂定之。<0}
{0>Article 2 A vocational school is a place where vocational education is carried out, and in accordance with the provisions of Article 1 of the Law provides the following education and training: <}0{>第2條 職業學校為實施職業教育之場所，依本法第一條之規定實施左列各項教育與訓練：<0}
{0>1. enriches vocational knowledge and skills;<}0{>一 充實職業智能。<0}
{0>2. instills professional ethics;<}0{>二 增進職業道德。<0}
{0>3. fosters the development of work habits;<}0{>三 養成勞動習慣。<0}
{0>4. imparts a sense of civic responsibility;<}0{>四 陶冶公民道德。<0}
{0>5. promotes robust health; and<}0{>五 鍛鍊強健體格。<0}
{0>6. encourages the development of an entrepreneurial spirit.<}0{>六 啟發創業精神。<0}
{0>Article 3 Vocational schools shall be classed in the following categories: agriculture; industry; business; marine technology; fisheries; medical technology; nursing and midwifery; home economics; arts; drama; and others. Where a vocational school encompasses two categories, the following may be deemed as a single category: business and home economics; marine technology and fisheries; medical technology and nursing & midwifery; and arts and drama.<}0{>第3條 職業學校分為農業、工業、商業、海事、水產、醫事、護理助產、家事、藝術、戲劇及其他等類，二類併設時，商業及家事類、海事及水產類、醫事及護理助產類、藝術及戲劇類得視為一類。<0}
{0>Article 4 The term of study in regular departments at vocational schools shall be three years.<}0{>第4條 職業學校一般類科之修業年限為三年。<0}
{0>However, the term of study in departments of a special nature may be extended or shortened to serve pedagogical needs after the competent educational authority submits a report to the Ministry of Education for approval.<}0{>但性質特殊之類科，為教學上之需要，須增減修業年限者，得由主管教育行政機關報請教育部核定之。<0}
{0>The term of study for students in a vocational school´s evening division shall be one year longer than that set forth in the preceding paragraph.<}0{>夜間部學生修業年限，應較前項規定年限延長一年。<0}
{0>Article 5 In addition to the admission requirements set forth in Article 4 of the Law, persons must in principle be under twenty-two years of age to qualify for admission to a vocational school.<}0{>第5條 職業學校入學資格，除依照本法第四條規定外，其年齡以未滿二十二足歲為原則。<0}
{0>However, this restriction need not apply to those who have special needs and have obtained the approval of the competent educational authority.<}0{>但因情形特殊，經報請主管教育行政機關核准者，不在此限。<0}
{0>Article 6 To be acknowledged as having "obtained an equivalent educational level" as referred to in Article 4 of the Law, a person must possess one of the following qualifications:<}0{>第6條 本法第四條所稱之同等學力，係指有下列情形之一者而言：<0}
{0>1. have completed the third-year courses in a public or private junior high school or in a school providing the equivalent of a junior high school education, and holds a certificate of study attesting to this fact;<}0{>一 曾在公、私立國民中學或相當於國民中學教育階段之學校修業三年級課程，持有修業證明書者。<0}
{0>2. have completed coursework in a supplementary compulsory school attached to a public or private junior high school, or in a government-accredited private secondary supplementary school, and holds a course completion certificate;<}0{>二 曾在公、私立國民中學附設補習學校或已立案之私立中級補習學校結業，取得結業證明書者。<0}
{0>3. have passed a junior high school equivalency examination, and holds an equivalency certificate; or<}0{>三 經國民中學畢業程度自學進修學力鑑定考試及格，取得學力鑑定及格證書者。<0}
{0>4. hold a Class C technician´s certificate, or possesses a technician´s certificate that confers qualifications equivalent to level C or higher.<}0{>四 取得丙級技術士證或相當於丙級以上技術士證之資格者。<0}
{0>Article 7 Vocational schools shall in principle be established by special municipalities. However, counties, county-level cities, clubs, professional associations, or private persons may also establish vocational schools.<}0{>第7條 職業學校由直轄市設立為原則，但亦得由縣 (市) 、社團、職業團體或私人設立之。<0}
{0>National vocational schools may be established where economic circumstances merit or where the local government may not be suitable for undertaking the establishment thereof.<}0{>如因國民生計確有需要或不宜由地方政府辦理者，並得設立國立職業學校。<0}
{0>Prior to the establishment, amendment registration, or suspension of operations of a vocational school, a proposal or statement of reasons stating the economic, educational, demographic, and traffic conditions, and availability of resources within the school´s local area and the surrounding region shall be submitted in advance to the competent educational authority for approval.<}0{>職業學校之設立、變更或停辦，應根據學校所在地及附近之經濟、教育、人口、交通及資源等實際狀況，提出計畫或理由，報請主管教育行政機關核准後辦理。<0}
{0>Article 8 National (provincial) vocational schools shall be named by the Ministry of Education.<}0{>第8條 國 (省) 立職業學校校名，由教育部訂定之。<0}
{0>A vocational school established by a special municipality, county, or county-level city shall be named after the place where it is located.<}0{>直轄市或縣 (市) 立職業學校以所在地名為校名。<0}
{0>Where one place has more than two public vocational schools in the same occupational category, the schools there shall use place names covering a smaller area.<}0{>一地設有類別相同之公立職業學校二校以上時，以區域較小之地名為校名。<0}
{0>A private vocational school shall take a proper name other than the name of a place.<}0{>私立職業學校應採用專有名稱，不得以地名為校名。<0}
{0>Article 9 Within one month after the start of each academic year, a vocational school shall file a report including the following particulars to the competent educational authority for recordation:<}0{>第9條 職業學校應於每學年開始後一個月內，將左列各項逕報各該主管教育行政機關備查：<0}
{0>1. a roster of the teaching and administrative staff for the current academic year;<}0{>一 本學年教職員名冊。<0}
{0>2. a roster of new students, transfer students, students returning from leave, students on leave of absence, and students who have withdrawn;<}0{>二 本學年新生、轉學生、復學生、休學生及退學生名冊。<0}
{0>3. a report on the employment situation of the school´s graduates; and<}0{>三 畢業生服務狀況。<0}
{0>4. a list of changes in school facilities and equipment in the current year.<}0{>四 本年度校舍及設備之變更事項。<0}
{0>Article 10 Within one month after completion of final examinations each term, vocational schools shall file the transcripts of graduating students with the competent educational authority for recordation.<}0{>第10條 職業學校畢業生成績清冊，應於學期試驗完畢後一個月內報請主管教育行政機關備查。<0}
{0>Article 11A public vocational school´s funding shall be appropriated from the budget of the government to which that school belongs. A private vocational school´s funding shall be procured and allocated by its board of directors.<}0{>第11條 公立職業學校經費由其所屬政府編列預算支給；私立職業學校經費由董事會籌劃之。<0}
{0>Article 12 In addition to personnel expenditures, a vocational school shall budget appropriately each year for teaching and practicum expenditures based on actual needs, so as to account for the special features of vocational education and facilitate its administration.<}0{>第12條 職業學校每年除人事費外，有關教學及實習等費，應按實際需要妥予編列，以配合職業教育之特性及實施。<0}
{0>Article 13 A vocational school shall budget appropriately each year for the maintenance, expansion, and renovation of facilities.<}0{>第13條 職業學校每年應編列適當預算以維護、擴充及更新設備。<0}
{0>Article 14 Public vocational schools may waive tuition, provided that they may also collect miscellaneous fees and fees for materials used in the course of instruction.<}0{>第14條 公立職業學校得不收學費。但得收雜費及實習材料費。<0}
{0>Private vocational schools may collect tuition, miscellaneous fees and fees for materials used in the course of instruction.<}0{>私立職業學校得收學費、雜費及實習材料費。<0}
{0>The competent educational authority shall prescribe the tuition and fee rates referred to in the preceding paragraph.<}0{>前項收費標準，由主管教育行政機關核定之。<0}
{0>Article 15 The size of a class at a vocational school shall be no greater than fifty students and no fewer than twenty-five students, but where special circumstances require otherwise, a school may report to the competent educational authority for approval.<}0{>第15條 職業學校每班學生以五十人為度，至少須有二十五人。但因情形特殊者得報請主管教育行政機關核定之。<0}
{0>Article 16 A vocational school may report to the Ministry of Education and obtain its approval for various educational experiments to address specific needs.<}0{>第16條 職業學校為應特殊需要得報經教育部核准辦理各種教育實驗。<0}
{0>Article 17 The various departments in vocational schools shall use teaching materials in a flexible manner, shall emphasize experimentation and practice, and shall establish a seminar on pedagogy for each department to enhance pedagogical research efforts and further studies by the teaching staff. <}0{>第17條 職業學校各科教學應活用教材、注重實驗及實習，並應成立各科教學研究會，以加強教師教學研究及進修。<0}
{0>Article 18 A portion of the surplus revenues of the auxiliary business organizations run by a vocational school may be used to provide grants as a form of recognition for outstanding students or students participating in the operation of such organizations. These funds shall be included in the budget.<}0{>第18條 職業學校附屬作業組織之賸餘，得提成獎助成績優良學生或參與作業之學生，以資鼓勵，並應列入預算。<0}
{0>Article 19 A vocational school in a given occupational category shall in principle be located in an environment which is suited to the subjects taught at the school, and which facilitates industry-education cooperation programs and practicum activities.<}0{>第19條 各類職業學校之校址，以適合所設學科之環境，並便於建教合作及實習為原則。<0}
{0>Article 20 A vocational school with than 12 classes or fewer shall have a school lot of at least two hectares. For a school with more classes and students, the area of the school lot shall be increased in due proportion, subject to the approval of the competent educational authority.<}0{>第20條 職業學校之校地十二班以下者至少須有二公頃，班級及學生數較多者，應按適當比例增加，由主管教育行政機關予以核定。<0}
{0>However, for a school located in an urban area where land availability is limited and where making good use of the available space is possible, the preceding requirement shall not apply.<}0{>但都市地區校地不易購置，能利用空間者不在此限。<0}
{0>An agricultural vocational school shall have sufficient agricultural land area for use as hands-on practice plots, as required by the various kinds of departments established by each given school.<}0{>農業職業學校視設立科別之不同，應有足夠之實習農場用地。<0}
{0>Article 21 Vocational school facilities shall meet the following standards:<}0{>第21條 職業學校校舍應符合左列規定。<0}
{0>1. Where a vocational school has twelve classes or fewer, its building footprint shall be at least 2,600 square meters. Where there are more classes and students, the building footprint shall be increased in due proportion, subject to the approval of the competent educational authority.<}0{>一 建築面積十二班以下者至少須有二、六○○平方公尺，班級及學生數較多者，應按適當比例增加，由主管教育行政機關予以核定。<0}
{0>2. There shall be a sufficient number of school facilities, including classrooms, offices, library, sports fields, health center, armory, lavatories, student dormitories, accommodations for the teaching and administrative staff, cafeterias, and auditorium (or student activity center).<}0{>二 須有足量之校舍，包括教室、辦公室、圖書館、運動場、保健室、軍械庫、廁所、學生宿舍、教職員工宿舍、餐廳、禮堂 (或學生活動中心) 等。<0}
{0>3. Each classroom shall in principle accommodate fifty people with an average floor area of two square meters per person.<}0{>三 教室每間以容納五十人，每人占地面積二平方公尺為原則。<0}
{0>4. Vocational schools in the categories of agriculture, industry, business, marine technology, fisheries, medical technology, nursing and midwifery, home economics, arts, and drama shall provide sufficient practicum venues for students, including laboratories, workshops, farms, hospitals, ships, banks, and shops.<}0{>四 農業、工業、商業、海事、水產、醫事、護理助產、家事、藝術、戲劇等各類職業學校，應有足供學生實習之場所，如實驗室、工廠、農場、實習醫院、實習船舶、實習銀行、實習商店等。<0}
{0>Article 22 Vocational school equipment shall, in addition to compliance with the preceding two Articles, conform to provisions of standards governing facilities at vocational schools, provided that vocational school equipment may be purchased on annual installment in accordance with the proposal for establishment of the school. <}0{>第22條 職業學校之設備，除依前二條規定外，並須符合職業學校設備標準之規定，但得視設校計畫分年分期購置之。<0}
{0>Standards governing facilities at vocational schools shall be prescribed separately.<}0{>職業學校設備標準另定之。<0}
{0>Article 23 A public vocational school principal´s term of office shall run for four years, and the principal may be reappointed for one successive repeat term, provided that the principal shall be no more than sixty-five years of age. A private vocational school may model the terms of its principal´s employment upon the provisions of this Article.<}0{>第23條 公立職業學校校長任期為四年，得連任一次，但年齡以不超過六十五歲為限。私立職業學校得比照辦理。<0}
{0>Article 24 A vocational school with forty classes or more may have one executive secretary, with a teacher serving in the post concurrently. The executive secretary shall review documents and handle duties delegated by the principal.<}0{>第24條 職業學校四十班以上者，得置秘書一人，由教師兼任，辦理文稿之審核及校長交辦事項。<0}
{0>Article 25 The principal and every member of the teaching and administrative staff of a vocational school shall hold disciplinary responsibilities and shall act as role models as they instruct students in all academic and extracurricular matters.<}0{>第25條 職業學校校長及全體教職員均負訓導責任，應以身作則，指導學生一切課內外之活動。<0}
{0>A full-time vocational school teacher shall spend at least seven hours at school every day.<}0{>職業學校專任教師在校時間每日至少七小時。<0}
{0>Article 26 A vocational school shall have one homeroom teacher per class, appointed by the principal from among the full-time teaching staff to serve in a concurrent capacity and administer student discipline and guidance. <}0{>第26條 職業學校每班置導師一人，由校長就專任教師中聘兼之，辦理本班學生之訓育及輔導事項。<0}
{0>Article 27A vocational school with more than nine classes shall establish departments of academic affairs, disciplinary affairs, general affairs, and practicum supervision, each of which shall have subordinate sections, to be established pursuant to the following provisions:<}0{>第27條 職業學校逾九班者，設教務、訓導、總務、實習輔導四處，處以下設組，其規定如左：<0}
{0>1. For the academic affairs department: Schools shall have two sections (a curriculum & equipment section and a registrar section). At a school with twenty classes or more, the academic affairs department shall have three sections (a curriculum section, registrar section, and equipment section).<}0{>一 教務處：設教學設備、註冊二組；二十班以上者，設教學、註冊、設備三組。<0}
{0>2. For the disciplinary affairs department: Where there are twelve classes or fewer, the office shall have two sections (a disciplinary section and a physical education & health section).<}0{>二 訓導處：十二班以下者，設訓育、體育衛生二組；<0}
{0>Where the number of classes ranges from thirteen to less than twenty-five, the department shall have three sections (a disciplinary section, student guidance section, and physical education & health section).<}0{>十三班以上未滿二十五班者，設訓育、生活輔導、體育衛生三組；<0}
{0>Where there are twenty-five classes or more, the department shall have four sections (a disciplinary section, student guidance section, physical education & sports section, and health section).<}0{>二十五班以上者，設訓育、生活輔導、體育運動、衛生保健四組。<0}
{0>3. For the general affairs department: A school shall have three sections (a documents section, purchase & maintenance section, and cashier section).<}0{>三 總務處：設文書、庶務、出納三組；<0}
{0>Where a vocational school establishes auxiliary business organizations, the department may, subject to the approval by the competent educational authority, have a business management section.<}0{>設有附屬作業組織之職業學校，經主管教育行政機關之核准，得設經營組。<0}
{0>4. For the practicum supervision department: A school shall have three sections (a practicum section, placement section, and industry-education cooperation section).<}0{>四 實習輔導處：設實習、就業輔導、建教合作三組。<0}
{0>A school with nine classes or fewer shall have two departments (an academic & student affairs department and a general affairs department).<}0{>職業學校九班以下者，設教導、總務二處；<0}
{0>The academic & student affairs department shall have three sections (a curriculum section, registrar section, and disciplinary affairs section), while the general affairs department shall have no subordinate sections.<}0{>教導處之下，設教學、註冊、訓導三組；總務處不設組。<0}
{0>Where there are six practical skill classes or more, the vocational school may establish a Practical Skills Program as circumstances merit.<}0{>職業學校辦理實用技能班六班以上者，得視實際需要於適當單位增設實用技能組。<0}
{0>The duties of each department referred to in the preceding paragraph shall be subject to approval by the competent educational authority. <}0{>前項所定各單位之職掌，由主管教育行政機關核定之。<0}
{0>Article 28 Each department shall have one director, and each section thereunder shall have one chief. The posts of department director and section chief shall be filled by members of the teaching staff acting in a concurrent capacity (with the exception of the general affairs department, where each section may be headed by a member of the administrative staff). <}0{>第28條 各處置主任一人，各組置組長一人，除總務處所屬各組組長得由職員擔任外，各處主任及其所設各組組長均由教師兼任。<0}
{0>Article 29 A vocational school library may have one director, to be appointed by the principal from among teachers who have specialized knowledge in this field.<}0{>第29條 職業學校圖書館得置主任一人，由校長遴聘教師中具有圖書館專業知識者兼任之。<0}
{0>Article 30 Each department in a vocational school shall have one chairman. This position shall be filled by a full-time teacher from the same school acting in a concurrent capacity.<}0{>第30條 職業學校每科置科主任一人，由各該職業學校專任教師兼任之。<0}
{0>Article 31 The competent educational authority shall determine the number of instructors, administrative directors, custodians, clerk/secretaries, school physicians, registered professional nurses, registered nurses, technicians, assistant technicians, practicum instructors, and electricians to serve on staff at vocational schools.<}0{>第31條 職業學校教師、幹事、管理員、書記、醫師、護理師、護士、技士、技佐、實習指導員、電器管理員等員額編制，由主管教育行政機關定之。<0}
{0>Article 32 The number of military instructors and nursing instructors employed by vocational schools shall be subject to the provisions of the Standard Staffing Chart for Senior Secondary School Military (Nursing) Instructors, which is prescribed by the Ministry of Education.<}0{>第32條 職業學校軍訓教官及護理教員之編制員額，依教育部所訂高級中等學校軍訓 (護理) 人員編制員額設置基準表之規定。<0}
{0>Article 33 A public vocational school shall have an accounting unit to undertake budgeting, accounting, and statistics pursuant to the applicable laws and regulations.<}0{>第33條 公立職業學校設會計單位，依法令之規定辦理本校歲計、會計及統計事項。<0}
{0>A private vocational school may model its accounting operations upon the provisions of this Article.<}0{>私立職業學校得比照辦理。<0}
{0>Article 34 A public vocational school shall have a personnel unit to undertake personnel administration pursuant to the applicable laws and regulations. A private school may model its personnel operations upon the provisions of this Article.<}0{>第34條 公立職業學校設人事單位，依法令之規定辦理本校人事管理事項。私立職業學校得比照辦理。<0}
{0>Article 35 A vocational school shall establish a governing board composed of the principal, heads of all departments and offices, heads of all departments, and the entire full-time teaching staff or representatives of the teaching staff. The governing board shall be chaired by the principal, shall discuss major innovations, and shall convene at least once per semester.<}0{>第35條 職業學校設校務會議，以校長、各處室主管、各科主任、全體專任教師或教師代表組成之，校長為主席，討論重要興革事項，每學期至少開會一次。<0}
{0>Article 36 A vocational school shall guide individual students toward proper development based on their capabilities, aptitudes and interests. The scope of guidance shall include the following aspects:<}0{>第36條職業學校應就學生能力、性向及興趣，輔導其適當發展，其範圍如左：<0}
{0>1. personal matters; 2. academic guidance; and 3. placement services.<}0{>一 生活輔導。二 學業輔導。三 就業輔導。<0}
{0>Regulations governing guidance for vocational school students shall be promulgated separately.<}0{>職業學校學生輔導辦法另定之。<0}
{0>Article 37 A vocational school shall organize a guidance work committee. The principal shall serve concurrently as the committee chairperson, and shall appoint the heads of all departments and offices (including the director of military instruction) and relevant teachers to serve as committee members.<}0{>第37條 職業學校設輔導工作委員會，由校長兼任主任委員，聘請各處室主任 (含軍訓主任教官) 及有關教師為委員。<0}
{0>The guidance work committee shall in principle have one full-time guidance counselor for every fifteen classes. Each committee member shall be a teacher with professional qualifications, and shall be appointed to the committee by the principal. The principal shall select one of the guidance counselors to serve as chief guidance counselor, who is charged with planning and coordinating of guidance for all students.<}0{>輔導工作委員會置專任輔導教師，以每十五班置一人為原則，由校長遴聘具有專業知能之教師充任，並由校長就輔導教師中遴選一人為主任輔導教師，負責規劃、協調全校學生輔導工作。<0}
{0>Article 38 A vocational school shall establish the following committees:<}0{>第38條 職業學校設左列委員會：<0}
{0>1. Disciplinary committee: Composed of the principal, the dean of academic affairs, the dean of disciplinary affairs, the director of military instruction, and homeroom instructors appointed by the principal to deliberate upon and plan important matters related to disciplinary affairs. The principal shall act as the committee chairperson, while the dean of disciplinary affairs shall act as the committee secretary.<}0{>一 訓育委員會：由校長、教務主任、訓導主任、軍訓主任教官及由校長聘請導師若干人為委員，校長為主任委員，訓導主任為秘書，研討、規劃有關訓導之重要事項。<0}
{0>2. Advisory committee: Composed of the principal, the dean of each department, practicum course instructors, and hired experts or members of the business community. The committee shall be chaired by the principal and convened at least once per academic year to deliberate upon matters related to school development, teaching materials, practicums, and job placements.<}0{>二 顧問委員會：由校長、各處主任、實習科目教師及聘請專家或企業界人士為委員，校長為主任委員，研討有關學校發展、教材、實習及就業等事項，每學年至少開會一次。<0}
{0>Article 39 The vocational school shall establish an academic affairs committee composed of the dean of academic affairs, all of the department heads, the dean of disciplinary affairs, the director of military instruction, and the entire teaching staff or their representative(s). The committee shall be chaired by the dean of academic affairs and convened at least once per semester to deliberate upon matters related to teaching and the purchase of books, instruments, and equipment.<}0{>第39條 職業學校設教務會議，以教務主任、各科主任、訓導主任、軍訓主任教官及全體教師或其代表組成之，教務主任為主席，討論教學有關事項及圖書、儀器設備購置等事項，每學期至少開會一次。<0}
{0>Article 40 A vocational school shall establish a practicum supervision board composed of the director of practicum supervision, the dean of academic affairs, every department head, practicum course instructors, and technicians. The board shall be chaired by the director of practicum supervision and convened at least once per semester to deliberate upon matters related to practicum supervision. <}0{>第40條 職業學校設實習輔導會議，以實習輔導主任、教務主任、各科主任、實習科目教師及技術人員組成之，以實習輔導主任為主席，討論有關實習輔導事項，每學期至少開會一次。<0}
{0>Article 41 A vocational school shall provide the following three types of practicum activities:<}0{>第41條 職業學校實習方式分為左列三種：<0}
{0>1. Individual practicums: Cultivation of field plots, workpiece processing, projects assigned by an instructor, etc.<}0{>一 個別實習：如劃區耕種、點件製作、指定事件等。<0}
{0>2. Group practicums: Cooperation among groups of students in the same or different grades.<}0{>二 分組實習：如同級或異級學生分組合作。<0}
{0>3. Joint practicums: Cooperation among students in the same or different grade(s).<}0{>三 共同實習：如同級或異級學生合作。<0}
{0>In principle, student practicum activities must take place on campus. However, students preparing to graduate after the current academic year may take part in off-campus practicums in connection with industry-education programs, and may also participate in pre-employment training. In addition, all students may take part in off-campus practicums during the summer and winter vacations.<}0{>職業學校之實習課程，除應屆畢業生得配合建教合作在校外實習與辦理職前訓練外，非應屆畢業生以在校內實習為原則，但得利用寒暑假期間舉行校外實習。<0}
{0>In administering practicum activities, a vocational school shall formulate detailed practicum plans pursuant to curriculum standards, shall carry out phased implementation of the plans, and shall keep records thereof.<}0{>職業學校實習時應依照課程標準，編訂詳細實習計畫，次第實施並予紀錄。<0}
{0>Article 42 To promote more effective education, a vocational school shall cooperate [with the competent authority] in the administration of skill competitions and skill certification tests.<}0{>第42條 職業學校應配合推動技藝競賽及技能檢定，以增進教學效果。<0}
{0>Article 43 A vocational school shall provide the following placement services to students:<}0{>第43條 職業學校辦理學生就業輔導之工作項目如左：<0}
